Should You Fight a Speeding Ticket

Pay it

Let's say you've decided against the whole courtroom thing and have chosen to just pay your ticket. Here is a layout of what comes to follow:

  • Lose the cost of the fine. The average speeding ticket costs $150.
  • Points will then be assessed to your driving record. Depending on the severity of the charge, the average infraction will add 2 points (or more) to your record. Bear in mind that speeds in excess of 15 or 20 miles over the limit can add up to 6 points.
  • These points will remain on your record for a period of three years!
  • These points quickly make their way to your insurance company who then labels you as an 'unsafe' and 'high liability' driver.
  • The insurance company now wants to cover their 'risk' and increase your monthly premium. This increase will be for a period of 3 years at an average cost of $300 (or more) per year! That's $900 in total extra monthly payments you must now make!

Once you observe the whole picture of what happens after you pay the fine, taking your ticket to court sounds more and more like the logical (and economical) thing to do. If the fine were the only punishment, it would be recommended to just pay it and be more careful next time.

But as you can clearly see, there's more to that ticket than meets the eye...

Fight it

So the option of paying the fine doesn't sound like a good idea anymore. Nor does a night next to Big Bubba sound tempting either. Your only other option is to take the ticket to court.

Now you will have to plead Not Guilty and wait for your trial date.

Simply by pleading Not Guilty, you have already given yourself a 30 to 50% chance of beating your ticket. If the officer fails to show up for court, your case should be dismissed.

Contrary to what you may have heard or believe, to fight a speeding ticket is a fairly straight forward process... when you do it the right way.

The key is to know what you're doing. Going to court unarmed and without a plan of action is a brainless decision and you can expect to lose. You may not be guilty of the charge against you, but without a valid defense, you give the courts no reason to dismiss your case.
